Please read these Terms of Service ("Terms") carefully before using AttendanceAF ("the Service"), operated by AttendanceAF LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who Can Use AttendanceAF
The Service is intended for use by higher education institutions, professors, and students. To use AttendanceAF:
- Professors must register with a valid institutional (.edu) email address
- Students must register with a valid institutional (.edu) email address
- All users must be at least 13 years of age
- Use of the Service constitutes your agreement that you meet these eligibility requirements
2. What the Service Does
AttendanceAF provides a web-based and mobile attendance tracking platform for college and university courses. The Service allows:
- Professors to create courses, start class sessions, and generate rotating QR codes for student check-in
- Students to check in to class sessions by scanning QR codes
- Professors to view, manage, and export attendance records
- Integration with learning management systems such as Canvas via CSV export
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to:
- Provide accurate and complete information when registering
- Keep your password secure and not share it with others
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
4. Acceptable Use
4.1 Prohibited Actions
You agree not to:
- Share QR codes with students who are not physically present in class
- Attempt to circumvent the rotating QR code system to fraudulently record attendance
- Access another user's account or attendance records without authorization
- Use the Service to harass, discriminate against, or harm any individual
- Attempt to reverse engineer, decompile, or interfere with the Service
- Use automated tools to scrape, spam, or overload the Service
4.2 Academic Integrity
Professors are responsible for ensuring that the Service is used in accordance with their institution's academic integrity policies. Fraudulent check-in (checking in on behalf of an absent student) may constitute academic dishonesty under your institution's code of conduct.
5. Data and Privacy
5.1 Data We Collect
We collect the following data to provide the Service:
- Full name and institutional email address
- Student ID number
- Attendance records (dates, times, and session check-ins)
- Course enrollment information
5.2 How We Use Your Data
- Attendance records are accessible only to the professor of the enrolled course
- Students may only view their own attendance history
- We do not sell, rent, or share your data with third parties for marketing purposes
- We do not use your data to train AI or machine learning models
5.3 FERPA Compliance
AttendanceAF is designed to support compliance with the Family Educational Rights and Privacy Act (FERPA). We implement the following measures:
- Student personally identifiable information is not displayed publicly or to other students
- Professors may only access data for their own enrolled courses
- Data is transmitted over encrypted HTTPS connections
5.4 Data Retention
Attendance records are retained for a period of two (2) years from the date of creation. Professors may export their data at any time via CSV export.
5.5 Data Deletion
You may request deletion of your account and associated data by contacting us at privacy@attendanceaf.com. Deletion requests will be processed within 30 days.
6. Payment Terms
- The standard rate is $10.00 USD per student per semester
- Payment is processed securely via Stripe
- Fees are non-refundable once a student has successfully checked in to a session
- We reserve the right to change pricing with 30 days' notice
- Failure to pay may result in suspension or termination of access
7. Intellectual Property
All content, features, and functionality of the Service — including but not limited to software, design, text, graphics, and logos — are the exclusive property of AttendanceAF LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
8. Disclaimers and Limitation of Liability
8.1 Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. AttendanceAF LLC is not responsible for system downtime, interruptions caused by internet connectivity issues, or data loss resulting from hardware failure or force majeure events.
8.2 Accuracy of Records
Professors are solely responsible for verifying the accuracy of attendance records. AttendanceAF is a supplemental tool and is not a substitute for official university record-keeping systems.
8.3 Limitation of Liability
To the maximum extent permitted by law, AttendanceAF LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid for the Service in the three months preceding the claim.
9. Termination
We reserve the right to suspend or terminate your account for violation of these Terms, fraudulent use, non-payment, or any conduct determined to be harmful to other users or the Service.
You may terminate your account at any time by contacting support@attendanceaf.com.
10. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Maricopa County, Arizona.
